Name Changes for Gay Couple, In re: Justice; In re: Dye

Brian Justice and Michael Dye were married in Iowa and live together in Virginia. In 2009, they sought to change their last names to “Dye-Justice.” Their application was denied based on the judge’s conclusion was that the purpose of the name change was for Brian and Michael to hold themselves out as married, in violation of Virginia law. Following our victory in the Hunter case, Brian and Michael reapplied for a name change. We represented them at their hearing on March 1, 2011 and on April 27, 2011, Judge Lowe granted the name changes.
